Termination of employment

The termination of an employee’s employment is often the most stressful and risky stage in the employer / employee life cycle. You may have an employee that has failed to meet your expectations, an employee that you suspect of wrong doing or you may have a need to restructure your business with consequential redundancies.

In all of these situations you will need to ensure that you act in a reasonable fashion, and follow due legal process. Mark Minns has substantial experience in supporting employers through an appropriate process in a wide range of scenarios that have led to a legally compliant termination of employment. These include:

  • Underperformance due to competence
  • Underperformance due to health
  • Conduct issues such as inappropriate behaviour or misuse of IT systems.
  • Large and small scale redundancy exercises
  • Business restructures
  • Retirement

From time to time employers may have commercial reasons for wishing to avoid following due legal process. We can help you in this process which will normally involve the drafting and negotiation of a compromise agreement providing for the termination of employment and a waiver of legal claims.
