Team moves and business protection

An article that looks at the legal issues associated with a team move.

It is not uncommon for employees in competitive markets to seek to move to a competitor business as a team. Given the likely commercial risks for the existing employer, legal action often follows, as was the case in Kynixa Limited v Hynes and others.

This case was unusual as it demonstrated the willingness of the Court to consider means of restriction other than those set out expressly in the employment contract.
